These Terms of Service (the “Terms”) govern your access to and use of the website located at shopgritual.com and any related pages, features, content, tools, products, and services offered by GRITUAL (“GRITUAL”, “we”, “us”, “our”) (collectively, the “Services”).

By visiting, browsing, or purchasing from the Services, you agree to be bound by these Terms and our Privacy Policy ([LINK]) and Returns & Refunds Policy ([LINK]). If you do not agree, do not use the Services.

1) Eligibility and account security

You must be legally capable of entering into a binding contract where you live. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We may refuse service, terminate accounts, or cancel orders where permitted by law.

2) Information accuracy

You agree that all information you provide (including shipping, billing, and contact details) is accurate, current, and complete, and that you are authorized to use the payment method you submit.

3) Products, made-to-order items, and availability

We sell apparel and related products, many of which are made to order / printed on demand after you place an order. Product images are for illustrative purposes; colors and appearance may vary by device settings, lighting, and production methods.

We may change product descriptions, pricing, and availability at any time. We may limit quantities per order or per customer where appropriate.

4) Orders, acceptance, and cancellation

Placing an order is an offer to buy. An order is accepted only when we confirm acceptance (typically via an order confirmation/processing notice) and receive authorization of payment.

Because many products are made to order, cancellation or changes may not be possible once production has started. If you contact us quickly, we will try to assist, but we do not guarantee changes or cancellations once an order is in production.

Your return/exchange rights are governed by our Returns & Refunds Policy ([LINK]) and any applicable mandatory consumer laws.

5) Prices, taxes, customs, and billing

Prices are shown in EURO unless stated otherwise. Taxes, shipping, and any additional charges are shown at checkout unless stated otherwise.

For international orders, you may be responsible for customs duties, import taxes, and brokerage fees imposed by your country. These are not controlled by us.

6) Shipping, delivery, and risk of loss

Estimated delivery times are estimates and not guaranteed. Delays may occur due to production capacity, carriers, customs, or events outside our control.

Risk of loss / responsibility for the goods:

  • EU/UK consumers: we bear the risk of loss or damage until you (or a person you designate) take physical possession of the goods (subject to applicable law).

  • Other customers (including many US transactions): unless prohibited by law, risk of loss passes to you upon our delivery of the goods to the carrier.

If a package is marked delivered but you cannot locate it, contact us and the carrier promptly so we can support an investigation.

7) Returns and refunds

Returns, refunds, replacements, and any exclusions (including for personalised/custom goods) are governed by our Returns & Refunds Policy . If you are an EU/UK consumer, you may have a statutory right to cancel within 14 days in certain cases, with exceptions such as personalised goods. 

8) Promotions, discount codes, and gift cards

Promotions may be subject to additional terms. Discount codes cannot generally be combined unless stated. Gift cards are non-refundable to the extent permitted by law.

9) Intellectual property and permitted use

All content on the Services (including trademarks, logos, product designs, text, graphics, photos, and site layout) is owned by or licensed to GRITUAL and protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial shopping purposes only. You may not copy, reproduce, distribute, modify, scrape, reverse engineer, or exploit any part of the Services without our prior written permission.

10) User content, reviews, and feedback

If you submit reviews, comments, photos, or other content (“User Content”), you:

  • represent you have the rights to submit it, and it does not violate any third-party rights; and

  • grant us a worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute such User Content for operating and marketing the Services (unless prohibited by law).

We may remove User Content that is unlawful, abusive, misleading, or otherwise inappropriate.

11) Prohibited conduct

You agree not to misuse the Services, including by:

  • violating laws or third-party rights,

  • attempting unauthorized access to systems or accounts,

  • transmitting malware or harmful code,

  • scraping or automated collection of data,

  • interfering with the normal operation or security of the Services.

12) Third-party services and links (including Shopify)

The Services may rely on third-party platforms (including Shopify) and may contain links to third-party sites. We are not responsible for third-party content, policies, or practices. Your use of third-party services may be subject to their terms.

13) Disclaimer of warranties

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain warranty disclaimers; in that case, disclaimers apply only to the maximum extent permitted.

14) Limitation of liability

To the fullest extent permitted by law, GRITUAL and its affiliates, officers, employees, partners, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising out of or related to your use of the Services or products.

Where liability cannot be excluded, our total liability will be limited to the amount you paid for the relevant order (or the minimum amount required by applicable law), except for liability that cannot be limited (e.g., fraud, wilful misconduct, or certain consumer rights depending on your jurisdiction).

15) Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless GRITUAL and its affiliates from claims arising out of your breach of these Terms, your unlawful use of the Services, or your violation of third-party rights.

16) Force majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control (including natural disasters, carrier interruptions, pandemics, war, strikes, supply shortages, or governmental actions).

17) Governing law and jurisdiction

If you are a consumer, you may benefit from mandatory consumer protections under the laws of your country of residence and these Terms do not take those rights away.

For all other matters:

  • These Terms are governed by the laws of ITALY, without regard to conflict-of-law principles.

18) Changes to these Terms

We may update these Terms from time to time by posting a revised version on the Services. Changes take effect on the date posted, unless a different effective date is stated. Where required by law, we will provide additional notice.
